KISSIPENNE’S “LAYAWAY” PROCESS AND REFUND & EXCHANGE POLICY  

Please note that there are FOUR ways to purchase an item from KissiPenne’s e-commerce site: “Buy”, “Bid”, “Offer”, or “Layaway”.

“LAYAWAY”

Terms:

  1. “Buy”: purchased from KissiPenne.com as a direct sale not as a “Bid”, “Offer”, or “Layaway”.
  2. “Purchaser”: the person whose credit or debit card was used to pay for an item or items from kissipenne.com.
  3. “Layaway”: is a contract between KissiPenne and a customer where KissiPenne agrees to an item or items for the customer until payment is made in full.
  4. “Not As Described”: the item or items received by the customer is SIGNIFICANTLY different from the listing description.
  5. “Two Business Days”: Monday through Friday of any week. If a state or federal holiday falls on the business day, the next day is considered the business day.
  6. “Shipping Address”: the address linked to the credit or debit card used to pay for an item or items from kissipenne.com.

“POLICY”

  1. ALL SALES ARE FINAL, AS IS, WHERE IS, AS FOUND
  2. We offer a Sixty-Day (60) LAYAWAY plan on ALL items over One-Hundred Dollars ($100).
  3. We require a deposit of Twenty-Five Percentage (25%) plus sales tax of Seven Percent (7%) on all layaway items.
  4. The amount paid as a deposit for the layaway shall bear no interest.
  5. If a layaway is cancelled within 60 days, KissiPenne will charge a 20% restocking fee.
  6. If a layaway is not redeemed after 60 days due to non- payment of the item(s), the would-be-purchaser is in default, and KissiPenne will charge a 20% restocking fee, which will be deducted from the deposit made by the would-be-purchaser, and refund the difference to purchaser, in the form of payment received.
  7. The deposit made does not cover the charge for shipping, which is separate and apart from the Layaway Agreement. Please see our Shipping Policy.
  8. Items offered for auctions cannot be placed on “layaway”.
  9. Items place on layaway cannot be returned or refunded.
  10. The Layaway agreement shall be governed by the laws of the State of Iowa, where the items are located.
